Acceptance of Terms
By accessing or using PokeCom, including the Discord bot, website, and official Discord server, you agree to these Terms of Service. If you do not agree, you must not use our services. In these Terms, "PokeCom," "we," and "us" mean the PokeCom project and the individual(s) who operate it.
Eligibility
- Users must comply with Discord's Terms of Service and Community Guidelines.
- You must meet Discord's minimum age requirement for your country (13 in the United States) to use PokeCom.
- If you are under 18 (or the age of majority where you live), you must have permission from a parent or legal guardian before making any purchase, and your parent or guardian agrees to these Terms on your behalf.
Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- PokeCom is not liable for unauthorized access to your account.
- Accounts may be suspended or terminated for suspicious activity or violations of these Terms.
- You may not share, sell, trade, or transfer your account to another person.
- Engaging in cross-trading, real-money trading (RMT), outside currency transactions, or any exchange involving PokeCom assets and external goods, services, or currencies is prohibited and may result in permanent account termination.
- Each user may have one (1) main account and one (1) alt account. See Section 04 for our full Alt Account Policy.
Alt Account Policy
PokeCom permits each user to operate a maximum of two (2) accounts — one main account and one alternative (alt) account. This is a privilege, not a right, and is subject to the rules below.
- Each person may have one (1) main account and one (1) alt account — a total of two accounts maximum.
- Alt accounts are subject to the same Terms of Service as main accounts. Any violation on either account affects both.
- Using an alt account to bypass a ban, suspension, verification requirement, or to gain an unfair advantage is strictly prohibited.
- If a user is found to be operating more than two (2) accounts total — meaning more than one alt — all associated accounts will be permanently banned, including the main account. No exceptions.
- If any account is used to evade a ban or suspension, all associated accounts will be permanently banned immediately.
- PokeCom staff reserve the right to determine account association at their discretion based on behavioral and technical signals.
- Account bans issued under this policy are final and non-appealable.
Prohibited Conduct
Users must not engage in any of the following:
- Engage in illegal, abusive, or harassing behavior.
- Exploit bugs or vulnerabilities in PokeCom.
- Use bots, scripts, autocatchers, or any automated tools to catch Pokémon, farm currency, or otherwise interact with PokeCom on your behalf.
- Use selfbots or user token automation of any kind.
- Share offensive, explicit, or inappropriate content.
- Attempt to circumvent PokeCom's systems, limits, verification requirements, or security measures.
- Operate more accounts than permitted under Section 04.
- Manipulate, exploit, or abuse the trading, auction, or marketplace systems.
- File a false or fraudulent payment dispute or chargeback (see Section 08).
Intellectual Property
PokeCom is an unofficial, fan-made community inspired by Pokémon. All original content on PokeCom, including its code, original artwork, and game systems, belongs to its creators. Pokémon and all related names, trademarks, logos, and characters are the property of Nintendo, Game Freak, Creatures Inc., and The Pokémon Company. PokeCom does not claim ownership over official Pokémon content, and nothing on PokeCom is official Pokémon merchandise or an official Pokémon product.
If you are a rights holder and have a concern about content on PokeCom, please contact us at [email protected] and we will review it promptly.
Virtual Goods and In-Game Currency
- All in-game currency, stardust redeems, and virtual items are part of PokeCom's fan-made system.
- When you purchase virtual goods, you receive a limited, personal, non-transferable license to use them within PokeCom. You do not own them, and they are not property.
- Virtual goods have no real-world monetary value, cannot be exchanged for real money, and are intended for use only within PokeCom.
- Virtual goods may be modified, rebalanced, or removed at any time without notice.
- PokeCom is not responsible for lost or unavailable virtual items or progress.
- Virtual items and progress on banned accounts are forfeited permanently with no compensation.
Purchases & Subscriptions
Purchases
- PokeCom offers optional paid items and subscriptions. All gameplay is available for free, and purchases are never required to play.
- Prices and what is included are shown before you buy. Payments are processed by Discord or our third-party payment provider; we do not store your full payment card details.
- Purchased items are delivered to the PokeCom account linked to the Discord User ID used at checkout. If an item does not arrive, contact us within 14 days and we will fix it.
Subscriptions
- Subscriptions renew automatically at the end of each billing period (for example, monthly) at the price shown when you subscribed, until you cancel.
- You can cancel at any time through the platform you subscribed on (for example, Discord's subscription settings or our payment provider), or by contacting support. Cancellation takes effect at the end of the current billing period, and you keep your benefits until then.
- If we change a subscription's price, we will announce it in our official Discord server before the new price applies to your next renewal.
Refunds
- Because virtual goods are delivered immediately, purchases are generally non-refundable, except where required by law.
- We may grant refunds at our discretion, for example for duplicate charges, delivery errors, or purchases made by a minor without a parent or guardian's permission. To request one, contact [email protected] or open a ticket in our Discord server.
- If a refund is issued, the related items, currency, or subscription benefits will be removed from your account.
Chargebacks & Payment Disputes
- Please contact us before disputing a charge with your bank or payment provider. Most issues can be resolved quickly through support.
- If you file a chargeback or payment dispute for a purchase that was delivered, we will remove the disputed items and currency (including anything obtained with them), and your account may be suspended or permanently banned.
- We keep records of purchases, delivery, and item use, and may provide them to the payment provider in response to a dispute.
Termination
- PokeCom may suspend or terminate accounts at its discretion for any violation of these Terms.
- Users will not be entitled to compensation for terminated accounts or virtual items.
- Users found operating alternative accounts after a ban or suspension will have all associated accounts permanently terminated with no right to appeal.
- Accounts banned for autocatcher or selfbot use are permanently ineligible for reinstatement.
- PokeCom reserves the right to terminate access for any reason, including inactivity or suspected abuse, without prior notice.
- If you believe your account was terminated by mistake, you may contact support to request a review. Except for bans under Section 04, we will review these requests in good faith.
Service Changes & Shutdown
PokeCom is a fan-made project. We may change, pause, or permanently discontinue PokeCom, or any feature, item, or Pokémon within it, at any time and for any reason, including technical, financial, or legal reasons or a request from a rights holder.
If PokeCom is permanently discontinued, all virtual goods, currency, and progress will end, and active subscriptions will be cancelled so you are not charged again. Except where required by law, no refunds will be owed for unused virtual goods or currency, or for time remaining in a subscription period. Where possible, we will give notice in our official Discord server.
Privacy
Our Privacy Policy explains how we handle user information. We encourage you to read it carefully to understand our practices.
PokeCom collects and stores your Discord User ID solely for the purpose of operating the bot and maintaining your game progress. We do not sell, share, or distribute your data to third parties, except to our payment provider as needed to process purchases and respond to payment disputes. IP addresses are used only for rate limiting and security purposes and are never stored permanently or logged to disk.
Disclaimer
PokeCom is provided "as-is" and "as available" without warranties of any kind. We do not guarantee that PokeCom will be uninterrupted, error-free, or available at any particular time. We are an unofficial, fan-made project and not affiliated with Nintendo, Game Freak, Creatures Inc., or The Pokémon Company. Use of the service is at your own risk.
Limitation of Liability
PokeCom and its creators will not be held responsible for indirect, incidental, special, punitive, or consequential losses of any kind connected to your use of the service. This includes, without limitation, lost profits, lost or corrupted data, damage to your device or systems, downtime, and the cost of finding a replacement service — regardless of whether such losses were foreseeable.
Should any claim against PokeCom nonetheless succeed despite the above, our combined liability for that claim — and for all claims arising from the same event or related events — is capped at one hundred United States dollars (USD $100) in total, or the amount you personally paid us in the prior twelve months, whichever is greater.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. In that case, our liability is limited to the fullest extent permitted by law.
Everything of value inside PokeCom — Pokémon, currency, items, cosmetics, and progress — exists only within the game and carries no value outside it. Playing PokeCom, including any optional purchases, is done entirely at your own risk. Continuing to use the service means you accept the limits described above.
Disputes & Governing Law
- If you have a problem with PokeCom, please contact us first at [email protected]. You agree to give us at least 30 days to try to resolve it informally before starting any formal claim.
- These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-law rules.
- Any claim that is not resolved informally must be brought in the state or federal courts located in Maryland, or in small claims court where eligible.
- If any part of these Terms is found unenforceable, the rest of the Terms remain in effect.
Updates
We may update these Terms from time to time. When we make significant changes, we will update the "Last updated" date above and announce the changes in our official Discord server. Continued use of PokeCom after changes are posted constitutes your acceptance of the updated Terms.
